All orders for the goods are to be made in writing with confirmation of the quote given.
Any amendments or additions must be received before goods enter production.
The buyer is responsible for checking the quotation and order confirmation, ensuring the goods are as required and that prices and delivery are correct.
Price and payment
Price and payment terms will be per the quotation supplied and signed by the customer.
Crest Timber Products Ltd reserves the right to charge interest at 5% above the base lending rate of the Bank of England. From time to time, in force, on all overdue payments from the due date until payment in full is received, whether before or after judgment has been entered.
Time of payment shall be the essence of the contract.
Crest Timber Products Ltd will use all reasonable endeavors to keep to agreed delivery dates, which are quoted based on existing commitments, but will not be liable for delay in delivery however caused. The time of the delivery shall not be of the essence.· If the goods are supplied with packing materials or crates, these are non-returnable and are the buyer’s responsibility for disposal as appropriate.
Crest Timber Products Ltd shall not be liable for loss or damage to the goods during transit unless the buyer notifies Crest Timber Products Ltd within 24 hours of delivery in writing. No claim will be eligible for compensation without being signed for as damaged when goods are delivered at the place of delivery.
Crest Timber Products Ltd shall not be liable for the re-delivery of goods where the buyer is not present to sign or accept delivery. The buyer shall bear any re-delivery or depot collection costs.
You may NOT cancel an order unless we agree in writing. Crest Timber Products Ltd will not agree to the cancellation of the order if the order is in production. You will be liable to pay the total costs.
Crest Timber Products Ltd warrants that the goods will be of merchantable quality and comply with their description, subject to normal trade tolerances. All kitchen and bedroom doors have a 10-year guarantee – see T&Cs – Any claim in respect of the guarantee must be notified to Crest Timber Products Ltd in writing, and the reason for the claim must be.
The buyer assumes responsibility for the goods being suitable for the purpose for which they are intended.
All tall panels and doors MUST be stored flat once delivered – don’t lean against the wall.
If the goods are ready for delivery but held back at the buyer’s request, or if the buyer fails to accept delivery, or the buyer has not cleared payment, Crest Timber Products Ltd may require the buyer to pay a reasonable storage charge after the expiry of 7 days from date of the buyer being notified that the goods are ready for despatch.
Reservation of Title
Until payment has been received in full, including any transport costs for goods supplied by Crest Timber Products Ltd.( A )– The goods shall remain the property of Crest Timber Products Ltd. (B) The buyer shall be at liberty to sell the goods in the ordinary course of business, Crest Timber Products Ltd may revoke this power by notice to the buyer if the buyer defaults in payment of the whole or part of the purchase price of goods.
Crest Timber Products Ltd shall not be liable for any consequential or special loss arising from any breach condition, guarantee or contract on the company’s part regarding the goods. Crest Timber Products Ltd’s liability for any such breach concerning the goods shall be limited to their net invoice value (at the Company’s discretion) to the replacement of the goods.
This contract is subject to the laws of the United Kingdom, and the buyer will submit to the exclusive jurisdiction of the United Kingdom courts.
